Abstract
The author has compared the institute of guarantee in Serbian law and other comparative legal systems, both continental and Anglo-Saxon. With the development of economy, these instruments of trustee’s protection in the contractual relationship have gained full promotion. The analysis of the similarities and differences in the treatment of guarantee implies a relationship between the European legal systems.
